Gambia Decides — Partner Terms of Use

1. Who we are and what this is. Gambia Decides ("the Platform") is operated by Cubixio Ltd, a company registered in England and Wales ("Cubixio", "we"). The Platform is an AI-assisted media-monitoring and incident-recording service provided to civil-society and observer organisations ("Partner Organisations") for the 2026 Gambian election cycle. These Terms govern access by individual users ("you") whose account has been created by, and is attached to, a Partner Organisation. By clicking Accept you agree to these Terms personally, and you confirm your organisation has authorised your use.

2. Pilot service, provided as-is. The Platform is a pilot provided free of charge, "as is" and "as available". To the fullest extent permitted by law, Cubixio excludes all warranties, conditions and representations, express or implied, including accuracy, completeness, availability and fitness for a particular purpose, and excludes all liability to you and your organisation arising from or in connection with the Platform, its outputs, or their use, whether in contract, tort (including negligence), or otherwise. Nothing in these Terms excludes liability that cannot lawfully be excluded; where any such liability arises, Cubixio's total aggregate liability is limited to £100. Your organisation is responsible for the decisions its users make on the basis of Platform outputs and for the use it makes of any export.

3. What the Platform's outputs are — and are not. (a) The Platform collects publicly available media content and field reports, and uses automated systems including artificial intelligence ("AI") to classify, summarise and surface that content. (b) AI outputs are descriptive inputs to human analysis. They are not findings, verdicts, or determinations of fact. Classifications, sentiment scores, share-of-voice proportions, "signals" and summaries may be wrong, incomplete or mistranslated (local-language transcription in particular has known accuracy limits). (c) The analyst is the decision-maker. Any incident status, verification, violation record, verdict, or escalation on the Platform reflects a decision by a human user of a Partner Organisation, not by Cubixio and not by an AI system. Cubixio does not review, endorse or take responsibility for those decisions. (d) You must not represent any Platform output as an official finding of Cubixio, of another Partner Organisation, or of any electoral or public authority.

4. Acceptable use. You will use the Platform only for lawful election-observation, media-monitoring and civic-integrity purposes on behalf of your organisation. You will not: (i) share your credentials or let anyone else use your account; (ii) attempt to access data of another organisation, or any data your role does not expose; (iii) probe, scan, scrape, reverse-engineer or load-test the Platform; (iv) upload content you have no right to upload, or that is unlawful, defamatory or contains a private individual's identity where the Platform's own rules exclude it; (v) use the Platform to target, harass, intimidate or profile any individual; (vi) use the Platform for party-political campaigning.

5. Confidentiality. (a) Other organisations' data. Field reports, verifications, verdicts and fact-checks belong to the organisation that created them. Where you can see another organisation's material, you may not copy, disclose, or act on it outside the Platform without that organisation's written consent. (b) Evidence packages and standards-violation records prepared for submission to the Independent Electoral Commission or another authority are confidential until formally submitted by the responsible organisation, and thereafter subject to that organisation's rules. (c) Platform outputs generally — dashboards, briefings, exports, screenshots — may not be published, re-transmitted, or provided to any third party (including media) without Cubixio's prior written consent and, where the material originates from another Partner Organisation, that organisation's consent. Internal use within your organisation for its observation mandate is permitted. (d) These obligations survive termination.

6. Roles and accountability. Your organisation's Administrator(s) are responsible for: creating and removing your organisation's users; assigning roles; ensuring users are staff or authorised volunteers of the organisation; ensuring field observers registered under the organisation are aged 18 or over and have been shown the Privacy Notice; and answering to Cubixio for their users' compliance with these Terms. Cubixio may suspend any account or organisation on reasonable suspicion of breach.

7. Personal data. Cubixio processes personal data as described in the Privacy Notice at gambiadecides.com/privacy, which forms part of these Terms. The allocation of data-protection responsibilities between Cubixio and your organisation is set out in the Data Processing and Joint-Controller Agreement between Cubixio and your organisation. If that agreement has not yet been signed, Sections 5 and 7 of these Terms apply in the interim and your organisation is treated as joint controller with Cubixio for data your users create.

8. Security. You will use a strong, unique password; enable multi-factor authentication when offered; and report any suspected compromise, unauthorised access or data leak to privacy@cubixio.co within 24 hours.

9. Intellectual property. The Platform, its software, methodology, taxonomies and aggregated outputs remain Cubixio's. Content your organisation uploads remains yours; you grant Cubixio a licence to host, process, display and analyse it for the purpose of providing the Platform. Third-party content displayed on the Platform belongs to its owners.

10. Term, termination, and end of cycle. These Terms apply for as long as your account exists. Either party may end access at any time. At the end of the 2026 election cycle (a date Cubixio will notify, expected within 90 days of the final declaration of results), Cubixio will, at your organisation's written election, either return your organisation's originated data (field reports, verdicts, fact-checks, evidence uploads) in a machine-readable export and then delete it, or delete it, except where retention is required by law or for the defence of legal claims. AI-collected public-source data and aggregated statistics are Cubixio's and are retained or deleted according to the Privacy Notice.

11. Changes. We may update these Terms; you will be asked to accept the new version at your next login. Continued use after acceptance constitutes agreement.

12. Governing law and disputes. These Terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, without prejudice to any mandatory rights your organisation has under the law of The Gambia.
